Atlantic Campers Terms and Conditions for Vehicle Hire
“The Hirer” refers jointly and severally to the person or persons who are the customers.
“This Agreement'” means the Rental Agreement, the insurance Motor Rental Agreement and these Terms and Conditions. In the event of any discrepancy between these Terms and Conditions and any other literature, the provisions of these Terms and Conditions shall apply.
“The Campervan Owner” means the person that rents a van to you through Atlantic Campers and is the legal owner or legal representative of that owner.
“Customer” means the person or persons nominated as the hirer in the booking
“Hire Details” on the insurance Motor Rental Agreement and any other person whose cheque is presented in payment of the customer’s charges.
“Equipment” includes but is not limited to the power pack, gas bottle, fridge, Satnav/Audio unit, bike rack, roof bars, crockery, cutlery, cooking utensils, pillows, sheets and any extra rented items such as awnings, WC and the like.
“Rental Period” means the hire period referred to on the Rental Agreement or any agreed variation thereof and any additional period during which the vehicle is in the Hirers possession or control.
“Vehicle” means the vehicle described on the Rental Agreement and includes tyres, tools, accessories, the equipment and any other special equipment, documents related to the Vehicle and any replacement or substitute Vehicle that may be provided at the discretion of The Campervan Owner.
“Security Deposit” means the Vehicle security deposit detailed under the heading “Security Deposit” in the Terms and Conditions.
Booking and Payment Details
Customers must submit a completed booking form to Atlantic Campers, together with a non-refundable booking deposit of £150, payable by cheque or credit /debit card.
The balance of the hire charge is due 6 weeks before the first day of hire.
Before customers can depart with the Vehicle on their day of hire, they must review and sign the Rental Agreement on arrival and a have signed copy of these Terms and Conditions.
By signing the Rental Agreement customers accept the conditions set out in the document which include, but are not limited to, conditions with regards to ‘Conditions for Using the Vehicle’, ‘Payment’ and ‘Collection and Delivery of the Vehicle’.
Security Deposit & Insurance
A £750 refundable Security Deposit will taken on the day of hire via credit card by Atlantic Campers.
This deposit is taken as security to cover the possibility of damage, whether negligent, willful, accidental or otherwise, loss to the van or the fixtures and fittings therein or the living equipment and windows, wheels, tyres etc. included with the van.
The customer must irrevocably authorise Atlantic Campers to deduct from the Security Deposit any amounts due by the customer to Atlantic Campers arising out of this Agreement.
If the Hirer has damaged the vehicle internally or externally, the value of this damage will be deducted from the £750 security deposit and the balance returned to the Hirer as soon as reasonably possible (to allow for damage estimates to be obtained). Damage of £750 or more will mean the full security deposit is not returned to the Hirer and Atlantic Campers may need to make an insurance claim to cover the additional costs. All repairs will be undertaken by a VW Commercial main dealer garage.
The security deposit will be refunded within 5 working days of the vehicle being returned on time, to the correct location, undamaged, with a clean interior, a full fuel tank and with all equipment in place and intact. We reserve the right to retain a £100.00 valeting fee if the Campervan is not returned with the interior in a clean condition.
The van has comprehensive insurance for the first and any other named drivers with an excess of £750 for any damage. Insurance is only for our van. The interior equipment and other items as specified in the Van Handbook are not covered by the Insurance and any damage will incur costs in addition to the Excess.
Failing to provide information may invalidate your insurance and render you liable for all losses howsoever sustained including claims by third parties.
These Terms and Conditions (including the cancellation policy) become binding on the Hirer at the time of booking whether or not they have been signed by the Hirer or not.
Should the Hirer wish to extend their hire period, this may be possible if the vehicle is not booked to another Hirer. The Hirer should contact Atlantic Campers to arrange this extension and pay the additional hire amount.
Hirers are advised to take out appropriate travel/holiday insurance to cover losses in the event of any unforeseen circumstances or cancellations; examples include illness, adverse weather, stolen bikes, etc. The Owner cannot provide this insurance cover.
Use of the Vehicle
The Vehicle is not to be driven otherwise than in a cautious, prudent and normal manner; driven by a person under the influence of alcohol or drugs or with a blood alcohol level in excess of that permitted by law; left with the ignition key in the vehicle while it is unoccupied; valuables concealed; driven by persons under the age of 25 years or who is not authorised by law to drive the Vehicle or named in the agreement; damaged by submersion in water; put into contact with Salt Water; used for any illegal purpose for any race, rally or contest; used to tow any vehicle or trailer not authorised in advance by The Campervan Owner; used to carry passengers or property for hire or reward; used to carry more persons than is permitted by any relevant authority or detailed in the Vehicle manual or on the Vehicle or specified in this agreement; used to carry volatile liquids, gases, explosives or other corrosive or inflammable material; or otherwise used in breach of the Hirers obligations under this Agreement.
All vehicles are supplied with a full tank of fuel at the start of the hire. Customers must return the vehicle with a full tank of fuel. Customers that return the vehicle with the fuel tank either empty or part full will be charged for the missing fuel at the end of the rental at the locally determined price, along with a fuel collection fee of £20. This can either be deducted from the Security Deposit or paid up-front.
Payment is preferred by UK debit card (Switch, Solo, Maestro, Visa, issued on UK banks only) or credit card (Visa, MasterCard). All rental charges are to be paid in full by credit or debit card 6 weeks before the first day of hire. Cheques are accepted, although they are not a preferred method of payment.
Driving Licence and Identification Required
7 days prior to the Hire Period, you will need to provide a driving licence check code from the DVLA.
On collection of the vehicle customers driving the vehicle must present their valid UK Driving Licence in person and with proof of their current address. No copies of licences will be accepted.
Drivers must be aged between 25 and 70 and have held a full driving licence for at least 3 years, have had no more than 2 minor motoring convictions in the last 5 years, have a maximum of 6 points and have had no more than 1 fault / no fault claim in the last 3 years.
Additional drivers must present a valid driving licence (both parts of new UK Licence are required).
Collection/Delivery and Return of the Vehicle
The Vehicle will be supplied in a clean condition and in sound working order in accordance with the Departure Checklist and with one semi-full and one full bottle of gas before they depart with the Vehicle. Customers must sign to acknowledge this. (The Rental Agreement will be produced for signature prior to departure).
Customers must comply with the collection and delivery times as set out in the Rental Agreement.
A late return fee of £25 per hour if the vehicle is not returned on time (we expect the hirer to return the vehicle on time as vehicles will require maintenance and inventory checks and need to be cleaned before being rented out again that same day).
The nominated valeting fee of £100 will be charged if the camper is not returned with the interior in a clean condition.
Rental Payment Terms
When paying by credit card customers must agree to the following:
Atlantic Campers are authorised to complete any documentation and to take any other action to recover from the customer’s credit card issuer all amounts due by the customer in accordance with this Agreement, including but not limited to, any amounts due in respect of damage to the Vehicle or to property of a third party and all other additional charges as they are incurred (this includes speeding fines and all parking and traffic infringement penalties and associated administration costs).
Customers will not dispute their liability to Atlantic Campers for any amount due under this agreement and shall indemnify and keep indemnified Atlantic Campers against any loss incurred (including legal costs) by reason of notifying the credit card issuer of such dispute.
All transactions under this agreement are conducted in Pounds Sterling. Due to exchange rate fluctuations, there could be some variance between the amount initially debited against credit cards and the amount refunded within 7 days after the expiration of the rental period. The customer must release Atlantic Campers from any liability for such variation.
When the customer books online they accept the conditions set out below:
The vehicle will be available on time and on the day it was requested.
If the customer does not arrive to collect their reserved vehicle on the day and at the time it was reserved no refunds will be made.
If the customer fails to pay the full cost of rental 6 weeks prior to hire then the booking will be cancelled (the initial booking deposit is non-refundable).
By booking online and accepting these Terms and Conditions you consent to Atlantic Campers applying charges to your credit or debit card account. You will not be required to make the excess deposit payment or pay for any possible additional rental costs until you collect your vehicle.
Terminating the Agreement
The customer acknowledges that Atlantic Campers may terminate this Agreement and repossess the Vehicle at any time, without notification to the customer, and that the customer will pay the reasonable costs of repossessing the Vehicle, including towing charges if:
They are in breach of any term of this Agreement.
They have obtained the Vehicle through fraud or misrepresentation.
The Vehicle appears to be abandoned.
The Vehicle is not returned on the agreed return date or Atlantic Campers reasonably believes that the Vehicle will not be returned on the agreed return date.
Atlantic Campers considers, on reasonable grounds, that the safety of passengers or the condition of the Vehicle is endangered.
The customer understands that in the event of such termination or repossession, they have no right to a refund of any part of the rental charges or the Security Deposit.
The booking deposit of £150 is non-refundable.
No refund will be given if the customer cancels within 28 days of the first day of hire.
In the event of cancellation, booking deposits are not transferable to alternative hire dates.
If appropriate identification and/or the necessary payment/deposit are not produced at the time the Vehicle is to be collected or the Terms and Conditions are not adhered to in any way then the rental cannot proceed and the cancellation policy will be enforced.
Cancellations may be only be made by contacting Atlantic Campers by phone or in writing.
In the event that your vehicle is unavailable for reasons out of our control, such as the vehicle has been involved in an accident prior to your agreed collection time of the vehicle, then we will endeavor to have a replacement vehicle in place. If a replacement vehicle is unavailable then we will refund all monies including your initial booking fee of £150.
The customer will have the vehicle for the rental period shown in the Reservation Confirmation and on the final page of the Rental Agreement.
If the vehicle is not returned on time, or if the customer does not contact Atlantic Campers requesting an extension of the rental then the conditions of this agreement have been broken.
Atlantic Campers will charge the customer for every day or part-day that the vehicle has not been returned.
Release and Indemnity of Atlantic Campers
Subject to its obligation to deliver the Vehicle or an appropriate substitute vehicle, the customer must release Atlantic Campers from any liability to the customer (regardless of who is at fault) for any loss or damage incurred by the customer by reason of this Agreement, including but not limited to:
Any loss or damage caused by breakdown, mechanical defect, accident or the Vehicle being unsuitable for the customer’s purpose.
Any loss or damage to any property left in or on the Vehicle or in Atlantic Campers’ premises or recovered or handled by Atlantic Campers.
Subject to any insurance arrangements agreed with Atlantic Campers, I hereby indemnify and shall keep indemnified Atlantic Campers, its employees and agents against any claims, demands and expenses (including legal costs) incurred or sustained by them or any of them by reason of my use and/or possession of the Vehicle.
During the enquiry and reservation process Atlantic Campers will collect personal information, including but limited to, your name, e-mail address, postal address and telephone number. This information is necessary for booking and for insurance purposes. We may use this information to notify you of any news you may interested in regarding Atlantic Campers. None of your personal information will be passed on to any third party companies (other than the insurance company that Atlantic Campers uses). Payment details including credit and/or debit card numbers, card expiry date and security code will be processed through a secure system.
